1.1 These terms and conditions set out the basis of the services that Wonderful provide to you and the wonderful charities and organisations that we support. They set out our obligations and your obligations when you use the Wonderful service.
1.2 We aim to provide a Wonderful service to all of our users. This includes making our terms and conditions clear, concise and without legal jargon.
1.3 They are however, important, as they govern our relationship with you when you use the Wonderful service.
1.4 Please take a moment to read and understand these terms and conditions.
1.6 Please be aware that by using the Wonderful services, you are accepting and agreeing to these terms and conditions.
2.1 We use some important terms in these terms and conditions:
2.1.1 Fundraisers: these are the people doing Wonderful things, whether that is running a marathon dressed as their favourite cartoon character, or cycling the length of the United Kingdom, these are the Wonderful people who Sponsors are supporting;
2.1.2 Sponsors: these are the people who provide sponsorship to our Fundraisers, whose generous donations go direct to great causes;
2.1.3 Charities: these are the organisations who are doing Wonderful things in the world. Sponsors and Fundraisers support Charities who are often special to them.
3.1 This is important. We don't charge any fees. We don't charge the Fundraisers a fee. We don't take a transaction fee from Charities who receive donations from Sponsors. We don't even deduct bank transaction costs from donations. We are quite proud of that. Wonderful is unique in ensuring donations get to your chosen Charities in full.
3.2 We are able to do that due to the kind support of our corporate sponsors. You can find details of all of our corporate sponsors on our website. They are doing Wonderful things.
4.1 The Wonderful services allow Sponsors to donate to, and Fundraisers to raise funds for, chosen Charities.
4.2 Charities in the United Kingdom and elsewhere are subject to regulation by governmental organisations. In England and Wales it is the Charities Commission. Wonderful do not control the legislation and regulation that applies to Charities. We do not accept any liability for the activities of the Charities, and we do not undertake due diligence or other verification on their use of donations provided through the Wonderful service. If you have any concern about the activities of any of the Charities who are supported through the Wonderful service, you should raise them with the charity in question, or if you have particular concerns, with the relevant regulatory body who have responsibility for the supervision of the charity in its country of operation.
4.3 We are authorised by all the Charities who are featured on the Wonderful service to collect donations on their behalf. Rest assured that donations will reach the relevant charity in full.
4.4 Any interest accumulated between the point at which a donation is taken on behalf of a charity and the point at which those funds are transferred to the charity is reabsorbed by Wonderful to cover its own running costs.
4.5 We have some further information on Gift Aid which is detailed below.
5.1 Please note that we do not regulate or control how your donations are used by the relevant Charities.
5.2 Charities are required to spend their funds only in ways that advance their charitable purposes. As Charities are subject to legislation in this respect, we cannot provide any information to you on how your donations are used.
5.3 We do not undertake audits or verification checks of any of the Charities, beyond confirming from publicly available information that the relevant charity has obtained charitable status in accordance with relevant legislation. Nevertheless, Wonderful will not be liable for any misuse of funds by Charities, or any application of funds in ways not contemplated by Fundraisers or Sponsors.
5.4 If you wish your funds to be used for a specific purpose, we recommend that you liaise direct with your chosen charity.
5.5 We do not recommend that donations be made under your will via the Wonderful service. If you are thinking of leaving a legacy for a charity, please do so only on the advice of an appropriately qualified professional such as a solicitor or accountant.
5.6 We do not provide accounting, tax or other financial advice on donations. Again, please seek advice from an appropriate professional.
5.7 Our policy on refunds is important. Please read this paragraph carefully. Wonderful believes that donations to Charities are important, and are a wonderful thing. Because of this, we do not provide refunds of donations. If your Fundraiser does not complete the challenge they set for themselves, you cannot request a refund of your donation. If you change your mind about donating, we will be unable to offer a refund. Please ensure that you are sure you wish to make your donation before donating via the Wonderful service. This is not intended to limit your statutory rights.
6.1 Please ensure you comply with these requirements when using the Wonderful service:
6.1.1 Do not upload offensive, obscene, racist or defamatory materials, anything which may reasonable cause offence, or anything which is a misrepresentation of fact.
6.1.2 Do not harass, abuse, bully or otherwise cause alarm to other users of the Wonderful Service;
6.1.3 If you are a Fundraiser, make sure that anything you upload is materially accurate and not misleading or intended to mislead. Make sure you have permission to use any materials you upload from the relevant copyright holder or other interested party. Don't upload any material if the person who owns that material has not provided you with permission. If we are notified that material has been used without permission, we may remove it;
6.1.4 Do not send unsolicited communications, including emails to other users;
6.1.5 Do not upload material that is unrelated to the Charities you wish to support or which is not relevant to the activities which you are undertaking in order to raise funds;
6.1.6 Do not undertake any activities which require a specific consent or authorisation, without obtaining such authorisation in advance. If we request a copy of such authorisation and you fail to provide evidence of such authorisation within a reasonable time determined by us, we may remove the relevant content;
6.1.7 Do not disclose the personal information of any user without their express consent;
7.1 When you donate to the Charities you are given the option of confirming that you are a UK taxpayer. Where you provide this confirmation, the relevant Charity (or Wonderful) are able to reclaim Gift Aid under the UK government's Gift Aid scheme.
8.1 The Wonderful service and website, and the intellectual property contained therein is owned by us.
8.2 You may not use the Wonderful trademark without our express prior written consent.
8.3 There may be intellectual property of third parties contained on our website (such as the intellectual property of Charities).
8.4 You are not permitted to use any such content for commercial purposes. You are granted no rights over such intellectual property by using the Wonderful service.
8.5 We will take whatever measures we see fit to block your access to the Wonderful service or website if we reasonably believe you are gathering or extracting content by any means for any purpose not approved by us in these terms and conditions or otherwise approved by us in writing.
9.1 Whilst we will make reasonable efforts to make the Wonderful service available at all times, we do not warrant that this will be the case. We may also suspend or interrupt our services for maintenance, whether planned or otherwise. We may also amend the scope and the extent of our services from time to time. We don't have to provide you with notice of any maintenance, interruption or change to our services.
9.2 We do not exclude our liability for death or personal injury.
9.3 We will only be liable for losses which are reasonably foreseeable to us. Our total liability to you will be limited to a sum not exceeding 200% of the value of the donations made by you in any 12 month period. We will have no liability to you for any consequential loss, loss of profits, loss of data, loss of business opportunity, loss of sales, loss of revenue, loss of goodwill, loss of opportunity or for loss of any management time.
10.1 These terms and conditions are governed by English law. Any dispute arising out of your use of the Wonderful services will be capable of being resolved and litigated only in the English courts.
The Co-operative Bank are proud to be the main sponsorship partner of the Wonderful Organisation supporting charities to make a difference by ensuring 100% of donations go directly to doing good. Learn more about the Bank’s values and ethics.
We recognise the selfless commitment made by fundraisers who train for months to run marathons, face their fears by jumping out of aeroplanes or open their homes to the community for charity bakes and coffee mornings. We believe the charities they support should receive EVERY PENNY from their fundraising efforts.
We also believe that Gift Aid (a scheme enabling charities to reclaim tax on donations made by UK taxpayers) should be directed IN FULL to the charities. This is why the Wonderful Organisation does not generate profit (or even cover costs) by deducting money from fundraisers' sponsors or Gift Aid contributions.
We are a non-profit organisation funded entirely by like-minded, philanthropic businesses. That's what makes us wonderful!
